TERMS OF SERVICE ( V1.1 ) ── .✦

These Terms of Service apply to all commissions confirmed on or after this date.By submitting payment, approving an invoice, or otherwise confirming the commission, you acknowledge that you have read, understood, and agreed to the Terms of Service outlined below.These terms form a binding agreement between the Artist and the Client. If you have any questions, you are encouraged to ask before payment is made.Failure to comply with any of these terms may result in actions at the Artist’s discretion, including warnings, cancellation of the commission, revocation of usage rights, or refusal of future work. Refund eligibility will follow the policies described in this document.The Artist reserves the right to decline commission requests based on subject matter, ethical considerations, workload, or other professional reasons. In such cases, the Client will be notified accordingly.

1. ENGAGEMENT & CLIENT RESPONSIBILITY

The Client must provide clear descriptions, references, and expectations before the project begins.The Client warrants that:✦ They have the legal authority to enter this agreement;
✦ They are the sole decision-maker and point of contact during the project;The Artist guarantees that:✦ The Work will be original to the best of their knowledge.
✦ No unauthorized copyrighted material will be copied or traced.
✦ Commercially licensed or royalty-free tools and assets may be used when necessary (including 3D base modeling in Blender for backgrounds).The scope of work, pricing, deliverables, and deadlines are defined via Discord, Email, VGen, Twitter, or other agreed platform before work begins.

2. CONTENT RESTRICTIONS

The Artist reserves the right to decline commission requests involving content that may cause discomfort or fall outside the Artist’s comfort or ethical boundaries. Any such content must be discussed and agreed upon prior to the start of the project.

3. PAYMENT & FEES

Accepted payment methods: PayPal.
All prices are in USD unless stated otherwise.Payment options:✦ 100% upfront;
✦ 50% upfront + 50%after sketch approval;Invoices must be paid before work begins. Clients must not send money before receiving confirmation from the Artist.Failure to complete the remaining balance after sketch approval may result in cancellation of the commission without refund of the initial deposit.As this commission is a custom digital service, the Client agrees that Any payment dispute should first be attempted to be resolved through direct communication whenever possible. Disputes related to completed or partially completed services may be considered a breach of this Agreement.Final delivery is considered completed once the commissioned work is delivered in its agreed format via Google Drive.✦ For sketch commissions, the delivery of the approved sketch is considered the final deliverable.
✦ For fully rendered commissions or flat colors, the delivery of the completed high-resolution artwork is considered the final deliverable.The commission type and deliverable specifications are agreed upon before work begins.Any payment dispute related to services that have been rendered, partially rendered, or delivered shall be considered a breach of this Agreement. In such cases, the Artist may revoke usage rights, cancel the commission, refuse future work, and provide relevant documentation to the payment processor for dispute resolution.

4. DEADLINES & TIMELINE

Standard individual commissions have a maximum completion time of 6 months, though most are completed within 1–2 months.Timeline depends on:✦ Complexity;
✦ Workload;
✦ Communication speed;If delays occur, the Artist will inform the Client.If no delivery is made after 6 months and no timeline extension was agreed upon, the Client may request a refund.Rush orders require an additional fee and prior agreement.

5. PROCESS & COMMUNICATION

Communication may occur via Discord, Email, VGen, or Twitter.The Artist provides weekly updates, which may include:✦ Work in progress previews;
✦ Delay notifications;
✦ Stage explanations;General workflow:Sketch → Colored Sketch → Lineart → Flat Color → RenderRevisions:✦ Major changes allowed during sketch phase;
✦ Minor adjustments allowed after lineart;
✦ Excessive revisions may incur additional fees;
✦ Revisions may extend timeline;The Client agrees to maintain reasonable communication during the project timeline. Extended silence (30+ days) may result in project pause without refund eligibility.Final files are delivered in PNG or JPEG via Google Drive or VGen. PSD files may be available depending on commission type.

6. COPYRIGHT & USAGE RIGHTS

All artworks remain the intellectual property of the Artist.The Artist retains the right to display the Work in portfolios, social media, streams, and promotional materials, and to share work-in-progress.If the Client prefers that work-in-progress not be publicly shared, this must be communicated before the project begins.A private commission option must be requested before work begins for an additional 30%of the base price. Under this agreement, the Artist will not publicly share the artwork, except when required for legal or dispute resolution purposes.Personal Use License (Default)The Client may:
✦ Post the Work on social media;
✦ Use as profile pictures, banners;
✦ Print for personal use or gifts;The Client may NOT:
✦ Claim the artwork as their own;
✦ Remove watermark/signature;
✦ Use for AI training, NFT, blockchain, or machine learning purposes;
✦ Sell or profit from the artwork;Credit is appreciated when possible.Commercial License (Optional – +50%)Commercial usage (products, merchandise, games, prints, monetized content, etc.) requires purchase of a commercial license for an additional 50% of the base commission price.Commercial terms may vary depending on scope.Usage for AI, NFT, blockchain, or machine learning remains strictly prohibited even under commercial license.

7. CANCELLATION & REFUNDS

If the Client cancels:✦ Before work starts: 100% refund;
✦ After sketch completion (flat/full color commissions): 50% refund;
✦ Sketch-only commissions are refundable only if work has not begun;No refunds after lineart stage begins.
If the Artist cancels, the Client receives a full refund.

8. CONFIDENTIALITY

Both parties agree not to share private personal or business information exchanged during the commission process.Private commissions or NDA agreements must be requested beforehand and may include additional fees.

9. INDEMNIFICATION

The Client agrees to indemnify and hold the Artist harmless against claims arising from:✦ Improper usage of the Work;
✦ Copyright infringement related to materials provided by the Client;
✦ Breach of this Agreement;

10. ACCEPTANCE

By paying the issued invoice, the Client acknowledges and confirms that they:✦ Are 18+ or have legal guardian consent;
✦ The Client is responsible for downloading and backing up delivered files;
✦ The Client acknowledges that the commission is a customized digital service and that refunds are subject to the progress and completion status of the Work;
✦ Understand and agree to all terms above;
